EU and China Seeking Extension of Appellate Deadline in WTO

Last December WTO Panel ruled that the antidumping measure against bolts and screws from China violated the rules of WTO. According to the ruling, the defendant and the complainant must appeal to the appellate division within 60 days after the publication of the report. The ruling will immediately come into force if the appeal is not applied before the deadline. Since the ruling was announced on 12/3/2010, the deadline will be at the beginning of February. However, the appellate division is currently dealing with lots of cases and the decision for each case should be made within 90 days after the appeal, so in order to appease the burden of WTO, EU, and China both hope WTO’s Dispute Settlement Body (DSB) can extend the deadline of appeals to 3/25. The application for extension will be reviewed by DSB on 1/25.
